Unless you are on vacation all summer, the dispute between Google and Microsoft should be old news. New developments have not occurred with the publication of are non-compete agreement signed by Kai-Fu Lee.
Google versus Microsoft
Earlier this year, Kai-Fu Lee quit Microsoft to to go to Google. In Lee allegedly violated a non-compete agreement he signed with Microsoft. Predictably, sued Microsoft Lee to prevent the move and started the brawl. Microsoft landed the first blow by a restraining order to prevent Lee from working for Google resolved until the case.
Non-Compete Language
As things progressed, the language has become known in the non-compete agreement. In general, Lee agreed not for a major competitor of Microsoft work when he left the company for a period of one year. The peculiarities of the language, but grossly entertaining
By signing the agreement, non-competition clauses Lee said:
1. "… Not to accept employment or engage in activities competitive with products, services or projects from Microsoft … … I was working or … learned confidential or proprietary information or trade secrets while employed. "
2. All disputes from the non-compete agreement would occur in the U.S. state of Washington.
Mr. Lee and Google have a serious problem. California courts rarely enforce non-compete Agreements, while Washington courts do. Because Microsoft sued first and Lee agreed with Washington in particular, should be responsible, in this case to remain in Washington. Google tries to to take the responsibility to California, but Microsoft beat them to the punch. Google's attorneys simply blew.
Prediction
Forecasts in Litigation is iffy at best, but Mr. Lee and Google have really fallen on their face in this one. Why do not they sue Microsoft in California court against Microsoft could react, which is mind boggling. The deck is stacked heavily in favor of Microsoft and you can take a clear victory for Microsoft or a settlement the conditions set by the Company expected.
